These terms cover your use of the Tap Vortex Shopify app ("the app"). The app is run by Tap Vortex, ABN 93 831 446 721, Australia ("we", "us"). By installing the app you agree to these terms and to the app privacy policy. Contact: hello@tapvortex.com.au.

The app

Tap Vortex lets you build vortexes: shopping pages that take each shopper through your offer, the right products and checkout, and remember them for next time. Vortex pages run on your own store through Shopify's app proxy and use your store's real cart and checkout.

Plans, trial and billing

  • Every plan starts with a 14-day free trial. You're not charged during the trial.
  • After the trial, your plan is billed monthly in USD through Shopify, on your Shopify bill. Prices are shown on the app's Plan page and our App Store listing.
  • You can change or cancel your plan any time from Shopify. Cancelling stops future charges. We don't give partial refunds for a billing period that has already started, except where the law requires it.
  • If we change a plan's price, we'll tell you at least 30 days before it applies to you.

Your store and your content

  • You own your store, products, images, words and everything you put into your vortexes. You give us permission to store and show that content only so the app can work for you.
  • You're responsible for what your vortexes say: offers, prices, claims, discounts and any legal wording your products need. Our "claim" blocks stay hidden until you edit them for this reason.
  • Don't use the app for anything illegal, misleading or harmful, or to break Shopify's terms.

Your shoppers' data (data processing)

  • For information about your shoppers, you are the controller and we process it on your behalf, only to provide the app (memory, reports, tests and, if you connect it, sending events to your own Klaviyo account). We don't sell it, use it for advertising, or combine it across stores.
  • We collect what the app privacy policy lists, respect your shoppers' cookie and marketing choices through Shopify's Customer Privacy API, and only sign shoppers up to marketing when they tick the box in your sign-up form.
  • We keep shopper data for no longer than 13 months, act on Shopify's data request and erasure requests, and delete your store's data when you uninstall the app (when Shopify sends the shop erase request, about 48 hours after uninstalling).
  • We use the providers listed in the privacy policy to run the app (hosting, database, and those you choose to connect, such as Klaviyo). We protect data with encryption in transit and at rest and limit access to the people who run the app.
  • If we become aware of a breach affecting your shoppers' data, we'll tell you without undue delay so you can meet your own obligations.
  • You're responsible for having your own privacy policy and, where required, a cookie banner on your store (Shopify provides one).

Tests and results

The app's split tests compare a vortex with your current page and show you the numbers. Results depend on your traffic, products and offers. We don't promise any particular increase in sales.

Availability and changes

We work to keep the app running, but it may sometimes be unavailable (for example during updates, or if Shopify or a provider has an outage). We may improve or change features over time. If we remove a feature you rely on, we'll give you notice where we reasonably can.

Liability

Nothing in these terms limits rights you have under the Australian Consumer Law or other laws that can't be excluded. Apart from those, the app is provided "as is", and our total liability to you for any claim is limited to the fees you paid us in the 3 months before the claim. We're not liable for indirect losses such as lost profits or lost data.

Ending

You can stop using the app any time by uninstalling it. We may suspend or end your access if you break these terms or Shopify's terms, after telling you where we reasonably can.

General

These terms are governed by the laws of Western Australia, Australia. If we update them, we'll change the date above and tell you in the app or by email if the change is significant.
